Deed Restrictions Overview
Deed Restrictions are subject to change.

 

  1. Kingsgate Country Estates is a mandatory HOA community.
  2. All Lots shall be used and occupied for single family residential purposes only. The Architectual Control Committee will approve all plans before building.
  3. Each single–story dwelling shall contain a minimum of 2800 square feet of air-conditioned floor area.
  4. Each two-story dwelling shall contain a minimum of 3200 square feet of air-conditioned floor area.
  5. The total exterior wall area of each building shall be no less than eighty-five (85%) percent brick, tile, concrete, stucco, stone or similar masonry materials.
  6. Each house is required to have its own buried propane supply. The propane tank must be installed per TRRC and Collin County regulations.
  7. No garage facing a street shall be permitted unless it is a detached garage constructed in the rear yard with the front of the garage door to the rear building line of the principal dwelling.
  8. Rear detached garages and outbuildings shall be permitted provided they are constructed in compliance with the requirements of these covenants.
  9. The front elevation roof pitch of any structure shall be a minimum of eight (8) feet by twelve (12) feet (8:12), and the side or rear elevation roof pitch of any structure shall be a minimum of six (6) feet by twelve (12) feet (6:12).
  10. Each Lot will have an On-site Sewer/Septic facility being an aerobic septic system and will be within the specification of On-site Septic Facilities as specified by the County.
  11. No fencing is required. Wire, chain link and privacy fences are strictly prohibited. Metal fence shall be square wrought iron fencing with a minimum of fifty percent (50%) open space.
  12. Electrical Meters, Phone Boxes and all utility connections will be located on the side or rear of dwelling.
  13. Each Lot shall be fully planted with grass and landscaped with planting beds and shrubbery. Landscape beds will not utilize more than 20% of the total Lot size.
  14. As part of the landscaping of the Lot, each Owner may install an underground sprinkler system providing irrigation to all areas of the yard.
  15. A minimum of 3, 1-inch caliper trees are required to be installed and maintained on each Lot.
  16. Gazebos, pool pavilions, trellises, greenhouses, storage sheds, barns, workshops or other similar structures are permitted but shall not be erected or placed on a Lot without prior written approval of the Architectural Control Committee.
  17. All trucks (in excess of one ton), motorcycles, mobile homes, motor homes, camp mobiles, campers, motorized vehicles, personal water craft or trailers shall be stored or placed in such a manner that the vehicle is not visible from any street or neighboring resident’s backyard.
